Plans - Terms & Conditions

The full terms and conditions of the use of the selected products and/or services are as set out at http://digi.my/tnc ("General Terms"), including the Data Protection Obligations as set out at http://digi.my/dataprotection together with Digi's Privacy Statement as set out at http://digi.my/privacystatement; all of which form an integral part of full terms and conditions of the said products and/or services (collectively, the "Terms and Conditions"). The Terms and Conditions are also accessible via Digi's website at http://www.digi.com.my. All terms and reference used herein shall be the same as the General Terms unless otherwise defined.

 

1. Mobile Internet Plans (applicable to Digi Prepaid NEXT Subscribers only)

1.1. Internet usage refers to Customer's access to the Internet via Digi's GPRS, EDGE, 3G Network or LTE Network (whichever applicable).

1.2. Digi does not guarantee or warrant the availability of the Internet usage and the Customer(s) acknowledges and agrees that the Internet is provided on an "as is" basis.

1.3. Digi reserves the right to revise, modify and/or change these terms and conditions at any time at Digi's sole discretion without providing notice to Customers. Continued use of this Service following any changes to these terms and conditions constitutes an acceptance to those changes (if any). Customers are advised to visit this page periodically to review the terms and conditions.

1.4. The existing Digi Prepaid Terms & Conditions shall apply and in the event of dispute over Mobile Internet matters, these terms and conditions shall prevail.

1.5. Digi reserves the right to terminate, suspend or block a Customer's usage of its services for any reason including but not limited for usage for the purpose of Voice Over Internet Protocol, P2P and Messaging services.

1.6. By subscribing to this Mobile Internet Plans, the Customers acknowledge that they understand the terms and conditions herein as well as the All General Terms and Conditions, including but not limited to the Privacy Statement and the Privacy Notice which are available on Digi’s website at www.digi.com.my, and agree to abide by them.

 

2. For the purposes herein, the following definitions shall be applicable:

2.1. Active Period means the period which the Subscriber is subscribed to either Monthly Active Plan or On Demand Plan.

2.2. Always Active means the Internet Package(s) which extends to both the line validity and internet validity.

2.3. Expiry Date means the last day of the Subscription Period.

2.4. Grace Period means the period between the expiry of the Subscription Plan and the Termination day.

2.5. Renewal Date means the date of renewal of the subscription for the Customers.

2.6. Subscriber means a customer who subscribe to Digi Prepaid NEXT rate plan.

2.7. Subscription Date means the date of which the Subscriber subscribed to Mobile Internet Subscription.

2.8. Subscription Fee means the charges for the Mobile Internet subscription.

2.9. Subscriber Period means the validity of the subscription once subscribed or renewed Thereafter.

2.10. Termination Date means the date of which the Subscriber terminates their Mobile Internet subscription.

 

3. Upon subscription, the fee of the Products shall be deducted from the Customer’s credit balance. However, Digi reserves the absolute right and discretion to revise the pricing of the Products for any reason whatsoever without the prior consent of the Customers. For the avoidance of doubt, the Customer is not entitled to use the amount available in their free Talktime to off-set the fee of any Products.

4. All offerings apply only within specific times (where applicable) or for selected third party service providers (where applicable) and when used within Malaysia.

5. All subscriptions are valid for domestic Internet usage only. The Customer shall be charged based on the Internet access rate imposed by the respective roaming operators for Internet usage whilst roaming with Digi's roaming partners.

6. Digi shall not be responsible in any way in the event that the Customer's subscription is activated by a 3rd party without their consent. Digi shall not refund nor compensate the Customer in any manner whatsoever in such situations.

7. The Products and offerings are provided on an “as is” basis and Digi does not guarantee or warrant that there will be no disruption, defect or error in the Internet access or usage provided by this subscription. Digi shall not be responsible in any way whatsoever for the loss incurred directly or indirectly for such failure or any disruptions associated to the network in any way whatsoever. The Products are optimised for Internet browsing on mobile phone and is not intended for peer-to-peer or file sharing applications. Digi reserves its absolute right and discretion to apply the Fair Usage Policy to the Products.

8. For any excessive usage, or on suspicion of fraud, any illegal practice or unusual activity in respect of the Customer’s account with Digi, Digi at its sole and absolute discretion reserves the right at any time without being liable to the Customer or any third party to discontinue, disconnect, interrupt, bar or suspend the service for such period of time as Digi shall deem fit.

9. The Products and their offerings cannot be transferred to any other mobile number.

11. Monthly Active Plan

11.1. Digi Internet Monthly Active Plan refers to a 30-day Internet pass, which are non-renewable (collectively “Products”).

11.2. These Products are available to Digi Prepaid NEXT subscribers only and can be purchased through MyDigi and USSD Menu Browser (‘UMB’) channel (by dialling *128#).

11.3. In general, there are 2 types of Monthly Active Plans

  • Cili Padi Unlimited Data
  • biGBonus Unlimited Voice

11.5. The Customer acknowledges and agrees that the Product does not include any subscription fee (if any) to any third-party service provider and such subscription fee shall be borne by the Customer.

11.6. The internet quota and bonus quota (where applicable) for mobile internet plans are offered on promotional basis and Digi reserves the right to revise any product offer without any prior communication to and consent of Customers.

11.7. The bonus quota (where applicable) will be refreshed every day during the subscription period of the internet plan. If the Customer terminates the internet subscription, the bonus quota will be terminated too.

11.8. Every purchase of the Digi Monthly Active Plan comes with Always Active.

11.9. In regards to Unlimited Social and Unlimited YouTube:

  • The unlimited Internet quota is applicable to usage of these service providers/partners: Facebook, Instagram and Twitter applications (“Partner Services”) for Unlimited Social and YouTube application for Unlimited YouTube.
  • In view of general concerns of possible abuse by certain Customers, the quota are subject to Digi's Fair Usage Policy which is available on https://www.digi.com.my/support/tnc/general/others/fair-usage-policy.
  • Digi reserves the sole and absolute right to cease, alter, suspend or substitute the Partner Services at any time without prior notice. For the avoidance of doubt, such alteration, cancellation, termination or suspension by Digi does not entitle the Customers to any claim or compensation against Digi (in cash or in kind) for any and all loss or damage suffered or incurred by the Customers as a direct or indirect result of the act of alteration, cancellation, termination or suspension.
  • Digi shall not be liable in any manner whatsoever to any party for any claims, proceedings, loss, damage, costs or expenses of any kind whatsoever suffered or incurred as a direct or indirect result of the utilization of the Partner Services.
  • Once the quota is fully utilised, any subsequent usage of the Partner Services will be deducted from the Internet quota according to the Customer's mobile Internet plan.
  • This quota is only applicable to the use of the Partner Services. Browsing of external links/pages not hosted by such Partner Services will be charged according to the Customer’s Internet quota.

11.10. Unlimited YouTube quota does not include other YouTube applications such as YouTube Kids, YouTube Premium and YouTube Music.

11.11. In regards to Internet Plans with Unlimited Calls:

  • applicable to domestic mobile/fixed on-net and off-net usage only and excluding video calls, calls to special numbers including but not limited to toll-free 1-300/1-800 numbers, and calls to 121 numbers;
  • strictly for standard person-to-person calls, and not meant for any commercial/non-personal usages; and
  • can only be utilised domestically i.e. within Malaysia network only. Calls made when overseas are subject to roaming charges. The Customers shall be charged based on the call rates imposed by the respective roaming operators for call usage while roaming with Digi's overseas roaming partners.

11.12. In the event of Product expiration or quota exhaustion, the Customer shall immediately revert to 32kbps Free Basic Internet if there is no other mobile Internet product purchased or subscribed to by the Customer.

11.13. Upon exceeding the base quota of mobile Internet plans, the Customers shall be directed to purchase Monthly Plan Booster or On Demand Internet. Digi reserves its absolute right and discretion to apply the Fair Usage Policy if the Customer is suspected to have had abused the Internet usage in whatsoever way including exceeding the fair usage limit.

11.14. The Customers are not allowed to subscribe and/or unsubscribe to Mobile Internet subscription for more than nine (9) times within a calendar month.

 

12. Monthly Plan Booster

12.1. Digi Monthly Plan Booster refers to a one-time Internet pass that follows Monthly Active Plan’s Expiry Date, which are non-renewable (collectively “Products”).

12.2. These Products are available to Digi Prepaid NEXT subscribers only and can be purchased through MyDigi only.

12.4. The Customer acknowledges and agrees that the Product does not include any subscription fee (if any) to any third-party service provider and such subscription fee shall be borne by the Customer.

12.5. The validity period of the Monthly Plan Booster will follow the validity period of the subscribed Monthly Active Plan until the expiration of the Monthly Active Plan. Any unused quota after the expiry date will be forfeited.

12.6. Digi shall not be liable in any manner whatsoever to any party for any claims, proceedings, loss, damage, costs or expenses of any kind whatsoever suffered or incurred as a direct or indirect result of the utilization of the Products.

12.7. In the event of the Product expiration or quota exhaustion, the Customer shall immediately revert to 32kbps Free Basic Internet if there is no other mobile Internet product purchased or subscribed to by the Customer.

12.8. Upon exceeding the base quota of mobile Internet plans, the Customers shall be directed to purchase another Monthly Plan Booster or Internet On Demand. Digi reserves its absolute right and discretion to apply the Fair Usage Policy if the Customer is suspected to have had abused the Internet usage in whatsoever way including exceeding the fair usage limit.

12.9. The Customers are not allowed to subscribe and/or unsubscribe to Mobile Internet subscription for more than nine (9) times within a calendar month.

 

13. On Demand Internet

13.1. Digi Internet On Demand Plan refers to a one-time short-term Internet pass, which are non-renewable (collectively “Products”).

13.2. These Products are available to Digi Prepaid NEXT subscribers only and can be purchased through MyDigi only.

13.4. The Customer acknowledges and agrees that the Product does not include any subscription fee (if any) to any third-party service provider and such subscription fee shall be borne by the Customer.

 

13.5. The internet quota and bonus quota (where applicable) for mobile Internet plans are offered on promotional basis and Digi reserves the right to revise any product offer without any prior communication to and consent of Customers.

13.6. Every purchase of the Digi On Demand Internet comes with Always Active.

13.7. With regards to the list of third party service provider(s) for the respective pass(es) (where applicable), the Customer may refer to the below:

  • For Video Freedom, please refer to: Video Freedom.
  • For social services, only Facebook, Instagram and Twitter are available.

13.8. The Internet speed of the Product with naming indication of ‘Lite’ is up to 512kbps.

13.9. In the event of Product expiration or quota exhaustion, the Customer shall immediately revert to 32kbps Free Basic Internet if there is no other mobile Internet product purchased or subscribed to by the Customer.

 

14. Other Applicable Terms

14.1. By using and/or subscribing to the Products, the Customer acknowledges that they understand the Terms and agree to abide by them.

14.2. Digi shall not be liable in any manner whatsoever to the Customers for any claims, proceedings, loss, damage, costs or expenses of any kind whatsoever suffered or incurred as a direct or indirect result of the utilisation of the Products.

14.3. Digi reserves the right to add, modify, upgrade, amend, change, remove, suspend or cancel any of the terms or features or offering relating to the Products from time to time without any prior notice and consent of the Customers. The continued use of the Products following any changes to the Terms of Use constitutes an acceptance to those changes (if any). The Customers are advised to visit this page periodically to review the Terms.

14.4. For the avoidance of doubt, such addition, modification, upgrading, amendment, changes, removal, suspension or cancellation does not entitle the Customers to any claim or compensation against Digi (in cash or in kind) for any and all loss or damage suffered or incurred by the Customers as a direct or indirect result of the act of addition, modification, upgrading, amendment, changes, removal, suspension or cancellation.

14.5. In the event there is a conflict or inconsistency between these Terms and Conditions and the General Terms and Conditions, the Terms and Conditions shall take precedence.
