Prepaid Broadband For PC & Tablet SIM Pack

1.The Terms and Conditions herein govern the use of internet and shall be applicable to Digi Prepaid Broadband For PC & Tablet customers (hereinafter referred to as "Customer(s)" or "You" or "Your") only.

2.Internet usage refers to the Customer's access to the internet via Digi Telecommunications Sdn. Bhd.'s ("Digi") data network eg. GPRS, EDGE or 3G (whichever is applicable) ("Service").

3.Digi does not guarantee or warrant the availability of the internet connection and the Customer(s) acknowledges and agrees that the Internet connection is provided on an "as is" basis.

4.Digi reserves the right to revise, modify and/or change these Terms and Conditions at any time at Digi's sole discretion without providing prior notice to the Customers. The Customer(s) acknowledges and agrees to be bound by these Terms and Conditions including all amendments, revisions, variations and/or additions thereto, if any, without any limitation and qualification. Customers are advised to visit this page periodically to review these Terms and Conditions.

5.Digi Prepaid Broadband For PC & Tablet does not take into consideration any free internet usage (in kilobytes) and/or free talktime (in RM) granted to Digi Prepaid Broadband For PC & Tablet Customer(s) at any point of time.

6.Digi Prepaid Broadband For PC & Tablet is optimised for internet browsing and it is not intended for peer-to-peer or file sharing applications. Digi reserves its absolute right and discretion to apply the Fair Usage Policy if the Customer is suspected to have had abused the internet usage in whatsoever way which shall include but is not limited to Digi's right to suspend, block or throttle the speed of the Customer's internet usage until such time as determined by Digi.

7.The Customer(s) acknowledges that internet usage will be blocked upon reaching the internet quota subscribed/reloaded.

8.Digi does not warrant or guarantee the delivery of the SMS notification to the Customer(s) in relation to the Service or the Digi Prepaid Broadband For PC & Tablet.

9.Digi Prepaid Broadband For PC & Tablet shall not be applicable to Customer(s) roaming on other domestic or international networks.

10.Once the Customer(s) subscribes to Digi Prepaid Broadband For PC & Tablet, the Customer(s) is not allowed to change plan to other Digi Prepaid Plans, Digi Postpaid Plans or port out to a different telecommunications service provider during the period of subscription.

11.Digi Prepaid Broadband For PC & Tablet is not applicable for porting in from another telecommunications service provider during the period of subscription.

12.All other terms and conditions governing the use of the Service, and/or the use by the prepaid Customer(s) in relation to the utilisation of Digi Prepaid Broadband For PC & Tablet shall apply herein mutatis mutandis.

13.Digi Prepaid Broadband For PC & Tablet is used solely for data access purposes. There are no voice capabilities, MMS, Talktime Transfer™ and outgoing SMS services on Digi Prepaid Broadband For PC & Tablet subscriber identification module ("SIM") card.

14.Digi Prepaid Broadband For PC & Tablet SIM card is not applicable for Reload Bonus or Birthday Bonus or any loyalty campaign offered to the voice plan Digi prepaid customers.

15.Charging of this data plan for Digi Prepaid Broadband For PC & Tablet SIM card is based on the reload validity and internet usage. Digi reserves the right to change such charging principles for Digi Prepaid Broadband For PC & Tablet SIM card without prior notice to the Customers.

16.The Digi Prepaid Broadband For PC & Tablet SIM card must be reloaded upon the expiry of the validity or the exhaustion of the internet quota, whichever comes first, failing which all internet access will be blocked.

17.Detailed instructions on how to reload the value of a Digi Prepaid Broadband For PC & Tablet SIM card can be found in the user guide attached thereto.

18.Every Digi Prepaid Broadband For PC & Tablet SIM card, once sold, shall not be refundable. Digi shall not be obliged to refund the Customer(s), and Digi shall not entertain any claim for any refund of, any unused portion of the value of a Digi Prepaid Broadband For PC & Tablet SIM card whether before or after its expiry period.

19.Every Customer is fully responsible for the use of their Digi Prepaid Broadband For PC & Tablet SIM card and Digi shall not be liable in any circumstances for any losses, expenses, damages, claims, liabilities or costs suffered or incurred by the Customer resulting from the failure by the Customer to do so.

20.Digi makes no warranty, express or implied, with respect to the services provided under the Digi Prepaid Broadband For PC & Tablet SIM card and Digi hereby expressly disclaims any warranty of merchantability, description or fitness for any particular purpose or function.

21.Digi reserves the right to change the Fair Usage Policy at any time.

22.Digi reserves the right to revise these terms and conditions (including pricing or charging principle) at its discretion without prior notice to the Customer(s) at any time. However, customer is responsible to regularly check the website for any changes on the pricing.

23.The use of the Digi Prepaid Broadband For PC & Tablet SIM card will also be subject to the following :-

• Digi Prepaid Broadband For PC & Tablet SIM Card General Terms and Conditions;
• Digi Prepaid Broadband For PC & Tablet Reload Coupons Terms and Conditions;
• Digi's Fair Usage Policy ; and
• Digi's General Terms and Conditions.

24.Each Digi Prepaid Broadband For PC & Tablet SIM card is not transferable, non refundable and must be activated before the use by date printed on it.

25.If Digi decides to cancel the Services as a result of the Customer's breach of any of the Terms and Conditions, all unused validity and internet quota in the Customer's account will be forfeited.

26.The Customer shall be responsible for all costs and losses resulting from any use of the Digi Prepaid Broadband For PC & Tablet SIM card and which arises prior to any lost or stolen case.

27.In the event of any lost or stolen Digi Prepaid Broadband For PC & Tablet SIM card, Digi will not be liable or obligated to refund or replace any remaining credit balance or validity to the Customer, the Customer's Digi Prepaid Broadband For PC & Tablet SIM card itself or the Customer's broadband number.

Reload Coupons

1.For the purpose of this plan, the reload coupon validity period and internet quota will be as stated in the website here and not as stated on the back of your reload coupon

2.The reload coupon validity period and the internet quota reloads purchased from alternate channels will be the same as the regular reload coupons.

3.Every time you reload the value of your Digi Prepaid Broadband For PC & Tablet SIM card, your SIM card will compare the remaining validity period of the reload coupon with the validity period of your new reload from your new reload coupon. The longest validity period from the two validity periods of the reload coupons will take effect.

4.Reload coupons that have passed the expiry date printed on them will not be usable nor returnable.

5.Reload coupons shall not be refundable. Any value that has been reloaded shall not be transferable nor refundable. Digi shall not be liable for any loss or damage due to reloading errors caused by the user of the reload coupon.

6.Digi reserves the absolute right, without any liability whatsoever, to block any access to the internet, if the validity period of the reload coupon expires or if the internet quota is reached, whichever comes earlier.

7.Accumulated Internet quota from reloads or Bonus granted shall not exceed the maximum cap stated on the website here at any point of time. Digi shall, at all times, be entitled to forfeit any quota exceeding the maximum cap allowed.

8.Digi shall, at all times, be entitled to forfeit any remaining unused reload value or any remaining unused internet quota after the expiry of the validity period of the reload coupon.

9.Any reload performed using any of the alternate reload channels outlined in the user guide or via any other channel which may be added from time to time will be subject to their own respective terms and conditions that are not governed by Digi.

Bonuses

Tenure Bonus

1.Digi Prepaid Broadband For PC & Tablet Customers are entitled for Tenure Bonus if they have fulfilled all the Terms and Conditions in relation to Tenure Bonus as stated here.

Usage Bonus

1.Digi Prepaid Broadband For PC & Tablet Customers are entitled for Usage Bonus if they have fulfilled all the Terms and Conditions in relation to Tenure Bonus as stated here.

2.Full calendar month usage volume will be taken into assessment for usage bonus. Hence, Usage Bonus entitlement for new customer will start from 2nd month upon activation.

3.Usage Bonus will then be granted to the entitled customers on the following month.

SIM Card

1.For the avoidance of doubt, the Digi Prepaid Broadband For PC & Tablet SIM card shall be terminated after the 30th day from the expiration of the validity period of the reload coupon and any remaining unused internet quota after expiry of the validity period of the reload coupon shall be forfeited.

2.It is Digi's policy to respect the privacy of its customers and take the issue of privacy seriously. By using Digi Prepaid Broadband For PC & Tablet SIM card, you hereby agree and consent to such details without limitation to your personal data/information being collected, processed and/or used by Digi in order to :

• conform to legal or regulatory or governmental requirements or comply with legal process; or
• protect and defend the rights or property of Digi; or
• provide relevant part of the Service or Digi Prepaid Broadband; or
• act to protect the interests of its customers or others.

3.You agree that Digi may access your account, including its contents, as stated above or to respond to the Service or technical issues or such other reasons Digi determines.

4.All applicable taxes, levies and/or duties are payable by you. You must reimburse Digi on demand for any such expenses which it is obliged to pay on your behalf.

5.Any information stipulated in this website or any medium which may be referred to from time to time will be considered to constitute part of the Terms and Conditions as contained herein.

6.Digi shall not be liable to reimburse or compensate you for any damages, costs, expenses or loss arising from the expiration or the termination of the reload coupons or SIM card.

7.Digi and its officers, employees, directors, agents and/or subsidiaries shall not be liable for any loss, damage, costs, personal injury or expenses suffered by you or any third party that arises directly or indirectly as a result of the following:

• any act, omission, error, default or negligence on the part of Digi or its business partners which shall not be limited to partners involved in providing/administering Digi's alternate reload channels; or
• any loss, distortion or mutilation of data; or
• unauthorised access or usage of the Service by any third party; or
• the unavailability of any part of the Service as a result of any mobile phone, inter-network or data format incompatibility, or as a result of any issues pertaining to network coverage, the unavailability of the internet or any other medium related to or required to access or use the Services or as a consequence of any other reason whatsoever; or
• the nature, quality and/or effect of the Services and/or the related content.

8.Digi makes no warranty, guarantee or representation, expressed or implied regarding the condition, merchantability, availability or fitness of any part of the Service, any service/equipment provided by any third party that is necessary for the access and/or use of the Services or for the quality of the Digi network or that of any other telecommunications service provider.

9.You agree to fully indemnify Digi and its officers, employees, directors, agents and/or subsidiaries, if any fraud, misrepresentation and/or unauthorised or unlawful use of the Service by you, your agents, representatives or employees result in any loss, damage, costs or expenses to Digi.

10.These Terms and Conditions will be governed by the laws of Malaysia.

11.These Terms and Conditions herein are subject to change without prior notice.
