Internet - Terms & Conditions

1.Internet usage refers to Customer's access to the Internet via Digi's GPRS, EDGE, 3G Network or LTE Network (whichever applicable).

2.Digi does not guarantee or warrant the availability of the Internet usage and the Customer(s) acknowledges and agrees that the Internet usage is provided on an "as is" basis.

3.Digi reserves the right to revise, modify and/or change these terms and conditions at any time at Digi's sole discretion without providing notice to Customers. Continued use of this Service following any changes to these terms and conditions constitutes an acceptance to those changes (if any). Customers are advised to visit this page periodically to review the terms and conditions.

4.The existing Digi Prepaid Terms & Conditions shall apply and in the event of dispute over Mobile Internet matters, these terms and conditions shall prevail.

5.Digi reserves the right to terminate, suspend or block a Customer's usage of its services for any reason including but not limited for usage for the purpose of Voice Over Internet Protocol, P2P and Messaging services.

6.By subscribing to this Mobile Internet Plans, the Customers acknowledge that they understand the terms and conditions herein as well as the All General Terms and Conditions, including but not limited to Privacy Statement which are available on Digi’s website at www.digi.com.my, and agree to abide by them.

Mobile Internet subscription

1.The terms and conditions herein govern the subscription of Mobile Internet plans for Digi Prepaid and the use of Mobile Internet.

2.For the purposes herein, the following definitions shall be applicable:

Customer(s)Means customers who subscribe to Mobile Internet subscription.
Subscription DateMeans the date of which the Customer subscribed to Mobile Internet Subscription.
Subscription FeeMeans the charges for the Mobile Internet subscription.
Subscription PeriodMeans the validity of the subscription once subscribed or renewed Thereafter.
Subscription RenewalMeans the renewal of the Customer's current subscription.
Termination DateMeans the date of which the Customer terminates their Mobile Internet subscription.

3.The Subscription Fee of mobile internet plans shall be deducted from the Customers' credit balance. However, Digi reserves the absolute right and discretion to revise the pricing of the Mobile Internet subscription for any reason whatsoever without the prior consent of the Customers. For the avoidance of doubt, the Customers are not entitled to use the amount available in their FREE Talktime to off-set against their Subscription Fee.

4.The table below states the details of Mobile Internet subscription plans:-

5.The internet quota and bonus quota (where applicable) for mobile internet plans are offered on promotional basis and Digi reserves the right to revise any product offer without any prior communication to and consent of Customers.

6.The bonus quota (where applicable) will be refreshed every day during the subscription period of the internet plan. If the Customer terminates the internet subscription, the bonus quota will be terminated too.

7.The Subscription Period is stipulated as the time from which the Customer subscribes to the Mobile Internet plan OR has his/her subscription renewed until the earlier of the end of the day that is 11.59pm OR when the next renewal takes place. For the avoidance of doubt, renewal of Mobile Internet subscription is scheduled at 12am. Nonetheless, due to common systems behaviour where processing (in this case Subscription Renewal) is sequential in nature, renewal for all Customers shall be in queue OR immediately after 12am if there is usage triggered by the Customer.

8.Upon exceeding the base quota of mobile internet plans, the Customers shall be directed to purchase Internet Top Up. Digi reserves its absolute right and discretion to apply the Fair Usage Policy if the Customer is suspected to have had abused the Internet usage in whatsoever way including exceeding the fair usage limit.

9.The Subscription cannot be transferred to any other mobile number.

10.The Subscription is valid for domestic Internet usage only. The Customer shall be charged based on the Internet access rate imposed by the respective roaming operators for Internet usage whilst roaming with Digi's roaming partners.

11.Internet usage whilst roaming with Digi's roaming partners.
The following sub-paragraphs shall apply to social quota only.

11.1The social quota is applicable to usage of these service providers/partners: Facebook, Instagram and Twitter apps (“Partner Services”).

11.2In view of general concerns of possible abuse by certain Customers, the social quota are subject to Digi's Fair Usage Policy which is available on https://www.digi.com.my/support/tnc/general/others/fair-usage-policy.

11.3Digi reserves the sole and absolute right to cease, alter, suspend or substitute the Partner Services at any time without prior notice. For the avoidance of doubt, such alteration, cancellation, termination or suspension by Digi does not entitle the Customers to any claim or compensation against Digi (in cash or in kind) for any and all loss or damage suffered or incurred by the Customers as a direct or indirect result of the act of alteration, cancellation, termination or suspension.

11.4Digi shall not be liable in any manner whatsoever to any party for any claims, proceedings, loss, damage, costs or expenses of any kind whatsoever suffered or incurred as a direct or indirect result of the utilization of the Partner Services.

11.5Once the social quota is fully utilised, any subsequent usage of the Partner Services will be deducted from the internet quota according to the Customer's mobile Internet plan.

11.6This social quota is only applicable to the use of the Partner Services. Browsing of external links/pages not hosted by such Partner Services will be charged according to the Customer’s internet quota.

12.Internet Rollover allocated with the Internet Plans:-

a.Balance Internet quota allocation will rollover upon on-time renewal only. Any transaction later than system-triggered renewal will not be applicable for Internet rollover.

b.In the event Customer does not fully utilize the Internet allocation, the balance Internet allocation shall be rolled over to the next subscription cycle, up to a maximum limit (ie: 100GB) upon on-time renewal. Balance quota more than the allowable maximum limit for rollover will be forfeited.

c.Only unutilised Internet quota from the Base quota will rollover to the next subscription cycle.

d.Unutilised Internet Rollover quota is not redeemable for cash or credit, and is non-transferable, whether by operation of law or otherwise, either to any other person, entity or any other Digi account.

13.Unlimited Calls allocated with the Internet Plans:-

a.apply to domestic mobile/fixed on-net and off-net usage only and excluding video calls, calls to special numbers including but not limited to toll-free 1-300/1-800 numbers, and calls to 121 numbers);

b.are strictly for standard person-to-person calls, and not meant for any commercial/non-personal usages; and

c.can only be utilised domestically i.e. within Malaysia network only. Calls made when overseas are subject to roaming charges. The Customers shall be charged based on the call rates imposed by the respective roaming operators for call usage while roaming with Digi's overseas roaming partners.

14.Upon 100% quota utilisation and within subscription validity, a Customer will not be able to access Internet, or will be throttled to lower speed for subsequent Internet usage, depending on the policy of the Internet subscription.

15.The Customers' Subscriptions shall be renewed according to its validity. Digi will send an SMS notification upon successful renewal. However, Digi does not guarantee the timeliness of the subscription renewal and shall not bear responsibility for any damages incurred directly or indirectly due to a delayed or failed renewal within the stipulated renewal window as stated in this clause.

16.If the renewal fails for any reason whatsoever, Digi will send notification via SMS to the Customer to inform the Customer of the failure. Failure of renewal may be due to inter alia either insufficient credit in the Customer's main credit balance OR the Customer is currently in inactive status due to validity. However, Digi shall not bear responsibility for any damages incurred directly or indirectly due to or consequences of failure to send out the SMS notification within the stipulated renewal window as stated in this clause.

17.In the event of a failed renewal due to insufficient credit or suspended status due to validity, Digi shall renew such subscription once the Customers had made the necessary top up or reload.

18.Mobile Internet subscription plans are on auto-renewed subscription. THE CUSTOMERS MUST TERMINATE THEIR SUBSCRIPTION IF THEY WISH TO DISCONTINUE THEIR SUBSCRIPTION.

19.The Customers can subscribe and unsubscribe via Digi's UMB channel (*116# OR *128#), MyDigi mobile application, MyDigi web (https://connect.telenordigital.com/id/heidetect?action=aborthei) or call in to Digi's Customer Service (by dialing +6016-2211800).

20.In the event of early termination prior to the Expiry Date, the Customers' Mobile Internet plan shall immediately revert back to 64kbps Free Basic Internet or Pay-As-You-Use (PAYU) Internet, according to Customer’s prepaid plan. In addition, the Customers shall not be refunded in any manner on the unused hours prior to the Expiry Date, even if the Customer subscribes again thereafter (no pro-rate of the Subscription Fee).

21.If the Customer did not exceed the fair usage quota within their Subscription Period, the Customer is not allowed to carry forward the unused quota to the subsequent Subscription Period.

22.The Customers are not allowed to subscribe and/or unsubscribe to Mobile Internet subscription for more than nine (9) times within a calendar month.

23.Digi shall not be responsible in any way in the event that the Customer's subscription is activated by a 3rd party without their consent. Digi shall not refund nor compensate the Customer in any manner whatsoever in such situations.

24.This Service is provided on an “as is” basis and Digi does not guarantee or warrant that there shall be no problem, defect or error in the Internet access or usage provided by this subscription. Digi shall not be responsible in any way whatsoever for the loss incurred directly or indirectly for such failure or any problems associated to the network in any way whatsoever. Mobile Internet plan is optimised for Internet browsing on the mobile phone and it is not intended for peer-to-peer or file sharing applications. Digi reserves its absolute right and discretion to apply the Fair Usage Policy if the Customer is suspected to have had abused the Internet usage in whatsoever way including exceeding the base quota.

25.If the Customers have FREE Kilobytes (KBs) in their Freebie account, the Customers' FREE KBs shall not be utilised until the Customers terminate their Subscription to Mobile Internet plan.
